September 22, 2014

Present: Chairperson Laleme, Selectman Blanchard, Selectman Fiorentino, Selectman Glavac.

At 6:30 pm Chairperson Laleme opened the meeting.

Rita Farrell came before the Board to discuss a noise ordinance. Ms. Farrell referred to a Warrant Article that passed in 1994 “In District II no dwelling or property shall be used so that it can be heard more the 20 feet from its property line between the hours of 10:00 p.m. and 7:00 a.m.” Ms. Farrell said there is a problem with noise and also said the bear ordinance couldn’t be enforced because of the Casella containers. Ms. Farrell asked about the authority of not enforcing the ordinance. Chairperson Laleme said she doesn’t know exactly but said the Board previously sought legal advice about this and the attorney said the Select Board didn’t have to enforce Site Plan Review. Chairperson Laleme said she wasn’t sure if that meant all ordinances or not and said the Board will research this. Ms. Farrell said there is a serious problem with noise coming from the landfill. Ms. Farrell also said that salaries of Town employees used to be listed in the Town Report. Selectman Fiorentino pointed out to Ms. Farrell that she came in to discuss the noise ordinance not about listing employee’s salaries in the Town Report. Chairperson Laleme also told Ms. Farrell that when she comes in to the Board she needs to indicate what she is coming in for and sticking to that. Chairperson Laleme said there is always public comment to speak but when on the agenda they need to stick to the agenda. Chairperson Laleme and Ms. Farrell discussed 91A. Andrea Bryant gave information on the dates on when the districts were created and asked about the Select Board enforcing the ordinances. Chairperson Laleme said the Planning Board attorney said it is up to the Select Board to determine whether or not to enforce the ordinance or not.

The Board reviewed the minutes from 09/15/14. Selectman Blanchard moved to approve the minutes as written. Selectman Glavac seconded. Carried 3-0 (Selectman Fiorentino abstained).

Ms. Farrell asked if the manifests for the Cruft Block are available to review. She was told yes.

There was discussion about the paving on Trudeau Road. Brett Jackson said the Town paid for the asphalt and the Town used NCES’s equipment for the paving. Mr. Jackson said they (NCES) were doing 100 feet because their trucks caused the damage and they had them use their equipment for the rest because it was a good deal.

Ms. Farrell said Route 3 to the Transfer Station is a mess because of Casella and asked if there is any obligation to make Casella fix it. Mr. Jackson said Brook Road is also a mess because of the trucks from Persons Concrete but they (Persons) don’t pay for the road maintenance.

Ms. Farrell asked about impact fees. Chairperson Laleme said the Planning Board is the one that can impose impact fees and there would have to be justification to impose the impact fees.

There was discussion about how long the new permit will last. Chairperson Laleme and Selectman Blanchard both said it is based on capacity.

Dick Robie said there was a reason why they did away with posting salaries and they can cause hard feelings. He also said they used to publicize who was delinquent on their taxes.

At 7:11 Chairperson Laleme moved to go into non-public per 91A for matters of personnel and reputation. Selectman Blanchard seconded. Chairperson Laleme did roll call with everyone agreeing to go into non-public session.

Selectman Culver arrived to the meeting.

The Board discussed personnel.

The Board discussed Recreation issues.

At 8:00 Chairperson Laleme moved to come out of non-public session. Selectman Fiorentino seconded. Carried 4-0 (Selectman Culver abstained).

At 8:00 Selectman Fiorentino moved to adjourn. Selectman Blanchard seconded. Carried 4-0 (Selectman Culver abstained).
