BETHLEHEM TOWN HALL MEETING ROOM

6:00 pm

 

Present:   Mike Bruno, Johnathan Stevenson, David Rodrigues, Linda Moore and Dave Wiley

Absent: Marie Stevenson, Neil Brody

Mike Bruno opened the meeting at 6:07pm. He then read the public notice for SPR changes.  Agenda:  2018 budget, Gravel Pits, SPR changes, and minutes from September 13, 2017.

Site Plan Regulation discrepancies was first to be discussed and voted on as follows:

Item 1: Proposed warrant article for March 2018 election

Regulation:

Section VIII   Parking: Section 8.1.6

The following dimensional standards shall pertain to parking at some angle to an aisle. The length and width describe a rectangle that would enclose a vehicle parking in that space:

  1. The space for a standard size automobile shall be 9 feet wide and 19 feet long;
  2. The space for a vehicle for the handicapped shall be 12 feet wide and 19 feet long;

Ordinance:

Article II- General Provisions

  1. Parking Requirement: a. In Districts I, II, III and IV, off-street parking, either by means of open air spaces, each having an area of ten (10) feet wide by twenty (20)feet long, or by garage space, shall be provided in accordance with this section whenever any new use is established or any existing use is enlarged.

Proposed change: Petitioned warrant article to change to industry standard of 9ft wide by 19ft long. (10 x 20 is minimum dimensions for garage parking) EPA suggests smaller dimensions to reduce impervious surfaces.

Item 2:

Site Plan Regulation:

Section 8.2.2   (Inn and Motel, Boarding House)

1 sp. per room plus 1 sp. per 3 employees

Plus additional requirements for other use over 100 square feet (sq.ft.)

Ordinance:

  1. Parking Requirement: Motels, hotels, guesthouses and mobile homes: 1 space per unit.

Proposed change: Change Site Plan Regulation to match ordinance of 1 space per unit.

Item 3:

Site Plan Regulation:

Section 8.2.5 (Office Buildings, Banks and Professional Services (lawyer, doctor, accountant, real estate or insurance office, etc)          1 space per 200 s.f. or g.f.a.

Ordinance

Public, commercial or professional offices: 1 space per 400 sq.ft.

Proposed change: Change Site Plan Regulation to match ordinance 1 space per 400 sq.ft.

Item 4:

Site Plan Regulation:

8.2.6 Multi-Family Housing 1 sp. per bedroom for first two plus ½ sp. per each additional bedroom

Ordinance:

Multi-family dwellings: 1.5 spaces per unit.

Proposed change: Reduce Site Plan Regulation requirements to match ordinance 1.5 space unit.

Item 5:

Site Plan Regulation:

8.2.7 Retail, Commercial or Service 1 sp. per 150 s.f. or sales floor area plus

Business (beauty shop, appliance 1 sp. per 600 s.f. of g.f.a. or storage

Repair, etc.)

Ordinance:

Retail floor space, community buildings, clubs, halls: 1 space per 200 square feet of principal use area. Public, commercial or professional offices: 1 space per 400 s.f.

Proposed change: Reduce Site Plan Regulation requirement to match ordinance of 1 space per 200 s.f.. Public, commercial, or professional offices: 1 space per 400 s.f.

Item 5.5

Site Plan Regulation:

8.2.10 Church or Community Building 1 sp. per every 6 seats (bench capacity is computed at 1 seat per 20 inches) or 50 s.f. or assembly room space.

Ordinance:

Theaters, restaurants, churches: 1 space per 3 seats.

Proposed change: Change Site Plan Regulation to reflect ordinance of 1 space per 3 seats.

Item 6:

Site Plan Regulation:

8.8 Energy Conservation Design:

(A) General Requirements. To protect community welfare and provide for more efficient use of community facilities, the Planning Board shall encourage conservation of energy in the design of developments to include the following:

8.8.1 Pedestrian and bicycle routes safely separated from automobile traffic.

8.8.2 Orientation and design of buildings for southerly solar access and minimum northerly exposure.

Proposed change: Delete section 8.8

Item 7:

Site Plan Regulation:

8.9 Performance Bond

The applicant may be required to provide a performance bond or irrevocable letter of credit to secure to the Town the actual construction and installation of improvements within a specified period of time as determined by the Board. The surety shall remain posted for a period of at least 60 days beyond the actual completion date to allow for inspection and approval procedures.

The surety shall be partially released as the improvements are completed, all in accordance with schedules and inspection as established by the Board in accordance with RSA 674. The amount of surety may be required to be increased if construction costs increase during the time of construction. Improvements requiring more than 12 months for completion will subject approvals to RSA 674:39.

The amount of the bond or letter of credit shall be based on an engineering cost estimate of the improvements. The Board may require an independent review of the cost estimate. The review shall be made by a professional selected by the Board and at the expense of the applicant.

No bond or letter of credit shall be released by the Board until the required improvements have been approved by the Town. All Town expenses related to determining if required improvements have been made shall be paid by the applicant.

Proposed change: The applicant may be required to provide a cash bond or “self-calling” irrevocable letter of credit to secure to the Town the actual construction and installation of improvements within a specified period of time as determined by the Board. The surety shall remain posted for a period of at least 60 days beyond the actual completion date to allow for inspection and approval procedures. This will be administered by the Selectmen’s office.

A simple “Developer’s Agreement” be signed between the town and the developer, to clearly document the obligations that are being secured, and the circumstances of bond reduction or release. A cash bond will be established by the treasurer with a separate bank account in the Town’s name.

Item 8:proposed warrant article for the March 2018 election

Zoning Ordinance:

Article V- Zoning Districts and Uses

  1. District I – Main Street Permitted Uses and Special Exceptions As reads: In District I Main Street no business shall operate so that it can be heard, more than 20 feet from its property line between the hours of 10:00 PM and 9:00 AM.

Proposed change: Town warrant article to change to: In District I Main Street no business shall operate so that it can be heard, more than 20 feet from its property line between the hours of 10:00 PM and 8:00 AM.

Mike Bruno motion Dave Rodrigues seconded 4-1 motion carries with 1 opposed Dave Wiley

Dave Wiley explained to the board that Police Chief Ho-Sing –Loy created a noise ordinance that was voted down before it went on the ballot. You cannot enforce spot force noise.  Dave will find the proposed noise ordinance paperwork and submit it to Debbie Bayley and then she will distribute it to the board.

Chris McGrath thanked the board for doing this. He would like to talk about a proposal for a warrant article for setbacks on existing structures.  He was told to complete the necessary steps for a warrant article.

Next was the budget, Mike Bruno presented his budget to the board. Monies created by fees accrued from SPR go into the general fund.  Budget is approved by the select board and money raised from the tax payers. Linda Moore asked if the board was trying to go 5% lower, Mike Bruno’s answer was no.  He cut the budget last year by almost 10%.  This year is up approximately 1500.00.  Planning/Zoning board has a very small budget in comparison.  He will present his budget to April Hibberd on October 23, 2017. The select board will see P/Z budget on October 30th.
