January 27, 2014

Present: Chairman Blanchard, Selectman Culver, Selectman Laleme, Selectman Fiorentino, and Selectman Glavac.

At 6:06 Chairman Blanchard opened the meeting.

Chairman Blanchard apologized for not making the Library open house.

George Brodeur, Doug Harman, Brian Schutt (DOT), Raymond Heath, Art Colvin (Horizon Engineering) and representatives from HP Cummings and library trustees came to discuss the ongoing issue with the driveway permit. George Brodeur said he feels after emails with Brian Schutt that a solution has been made. He explained he had acted as a go between with DOT and Horizons for quite some time. Mr. Brodeur said in his opinion things kept changing with every submittal to DOT. Mr. Brodeur said after Senator Woodburn contacted Brian Schutt the Driveway permit was finally received but he said it was when the asphalt plants were closing for the season. Mr. Brodeur explained the current issues with not notifying DOT within 48 hours for catch basin work, the issue with the connection pipe, and the “extra” catch basin. The work still required will be completed in the spring with Steve D. from DOT working with them as agreed with Mr. Schutt.

Doug Harman said HP Cummings called the # listed on the letter from DOT and called within 24 hours like the letter said. Mr. Harman also said every time DOT asked for changes they made them. Mr. Harman said the library has spent $68,000.00 because of these issues with DOT. He explained they had to do a study for parking for propane trucks backing up, retaining wall, swales, etc. Mr. Harman said DOT didn’t even know they had a catch basin there and he said they put in another one unnecessarily because DOT didn’t know about theirs. Mr. Harman also said the connectors that they put in are per spec so he doesn’t understand why DOT is requiring the different one.

Brian Schutt told the Board he is the District 1 engineer. He said on the permit itself one of the conditions had the # to call before performing the work. Mr. Schutt said DOT found out about this
project because they drove by and saw it; he said a driveway permit application was not submitted before they began the work. Mr. Schutt said the existing catch basin is a moot point because a basin was needed above the driveway and the one they found was below the driveway. Mr. Schutt explained the connection they are requiring is the same that is required all across the state.

Chairman Blanchard said it is time to move on; they need to pour concrete for connection and work together on driveway. Chairman Blanchard said the options that Mr. Brodeur and Mr. Schutt have worked out should be completed to resolve this.

Selectman Culver said a Town project should not happen without going through with Site Plan Review. He said this would not have happened if they had gone through with Site Plan Review.

Selectman Laleme said she felt the state’s response in the emails was very unprofessional and that they were being very inflexible.

Selectman Fiorentino said technologies change and regulations need to change with new technologies.

Chairman Blanchard asked Mr. Schutt if we were ok until spring when the work could be completed. Mr. Schutt said yes.

There was discussion about the cost of fixing the connection and getting the assurance from DOT that they would absorb the cost to repair and replace the catch basin that was discovered. Mr. Schutt said the state would absorb the cost of raising it up. Mr.Schutt said access to the Library would not be restricted as long as communication is good.

The Board reviewed the minutes from 01/09/14. Chairman Blanchard moved to approve the minutes as written. Selectman Glavac seconded. Carried 5-0.

Selectman Laleme said Victor Hoffman resigned as treasurer for the Bethlehem Chamber. Selectman Laleme said it has been funded by the Town all these years with Victor as Treasurer expending the funds so she feels expending the money should revert to the town. The Board will look into this further.

Dick Robie asked the Board why they are continuing to have work sessions and said he hoped in future weeks the work session isn’t on the agenda.

At 7:00 Chairman Blanchard moved to adjourn. Selectman Glavac seconded. Carried 5-0.
