BETHLEHEM TOWN HALL MEETING ROOM
Minutes
6:00 pm

Attendance:  Mike Culver, Patrick Doughty, Alan Jackson, Amy Delventhal and
Chairman Lon Weston

Mr. Weston opened the meeting at 6:00 pm.

The board went over minutes from February 14, 2017.  Amy motioned to approve and Patrick Doughty seconded. 5-0 motion carries

Amy Delventhal read the public notice for Bethlehem DG LLC application for two Variance requests.
Mr. Doughty read the checklist.  Amy motioned to accept the checklist as complete. Pat seconds 5-0 motion carries.

Mr. Doughty let the board know that he does not think that DG needs a Variance for parking.

Lon Weston would like to get to the Variance for parking during the Criteria and after Mr. Turner presents his project.  The second variance request is for green space.  Mr. Doughty said that green area is not defined in our ordinance. He also asked if the applicant has contacted DOT.  Yes Mr. Turner stated that the application is already in.
Mr. Turner explained that the store will be 85 x 85 feet. 7,225 square feet, and it will be open 7 days a week 8-10.  Deliveries will be before opening on non peak times, with delivery usually only taking about 30 minutes.  Amy asked about the new look on the façade. It will be 3 toned to blend in with the area.  Chris McGrath said that this should be considered at the Planning Board level, at the SPR tomorrow night.  Dave Van Houton read the letter to the zoning board from the Huggins. (Hearthside Village)   It will be enclosed with the DG file at the town hall. Peter Roy would like to know about the parking.
Lon Weston said that the Planning Board can waive their site plan regulations. Parking is compliant with the zoning ordinance.  The Green space needs a Variance.  Rita Farrell wanted to know about banners on the building.  This is irrelevant said Mike Culver.  That is a Select Board issue.  We are only here for parking and green space.

Austin Turner explained where the property starts and where DOT/ROW is.  Jesse Delventhal Parker would like to ask if there are plans for a traffic light.  The answer was no, from Austin Turner, the project will not warrant it.  Cheryl Jenson told the board that the letter from the Conservation Committee was not saying yes or no to the project only that they recommended the Variance due to the wetlands.

Mike Culver made a motion that there is no need for a parking variance.  Amy Delventhal seconded 5-0 motion carries.

Variance #2
Article 11, Section A:
Requirement:
Excepting curb/driveways, a green area shall enclose the entire lot perimeter as follows –               minimum width of green areas shall be fifteen (15) feet that where the area abuts a public right- of- way, such area shall be not less than thirty (30) feet.

Requested:
A proposed green area along the right -of- way of approximately 5.6t feet wide.

Pat Doughty read the criteria.

1. The proposed use would not diminish surrounding properties values
Pat Doughty motion to accept C1 Alan Jackson seconded 5-0 motion carries

2. Granting the variance would not be contrary to public interest
Pat Doughty motion to accept C2 Alan Jackson seconded 5-0 motion carries

3. Denial of the variance would result in unnecessary hardship to the owner
Amy Delventhal motion to accept C3 Alan Jackson seconded 5-0 motion passes

3a.
The zoning restriction as applied to the applicant’s property interferes with the applicant’s reasonable use of the property, considering the unique setting of the property in its environment
Amy Delventhal motioned to accept C1a Alan Jackson seconded 5-0 motion carries

3b.
No fair and substantial relationship exists between the general purposes of the zoning ordinance and the specific restrictions on the property
Mike Culver motioned to accept 3b Amy Delventhal seconded 5-0 motion passes

3c.
The variance would not injure the public or private rights of others
Patrick Doughty motioned to accept 3c Amy Delventhal seconded 5-0 motion carries

4. Granting the variance would do substantial justice
Amy Delventhal motioned to accept C4 Alan Jackson seconded 5-0 motion carries

5. The use is not contrary to the spirit of the ordinance
Patrick Doughty motioned to accept Amy Delventhal seconded 5-0 motion carries

Amy Delventhal motioned to approve the 5 Criteria’s for the Variance.  Alan Jackson seconded 5-0 motion carries

Variance is approved for Dollar General to have a green area along the right-of-way approximately 5.6 feet wide.

Board Business
Lon Weston would like to nominate Patrick Doughty to Co-Chair until after the election on March 14, 2017.  5-0 unanimous

Amy Delventhal motioned to adjourn.   Patrick Doughty seconded 5-0 motion carries

Adjourned 8:00 pm
